Terms of Use

Last updated: October 12, 2026

These terms govern your use of Mynk, also titled Tutoring Notes, a web application operated by Andrew Mortensen (“Operator,” “we,” “us”) under the Mortensen Apps umbrella. They supplement the umbrella terms of service at www.mortensenapps.com/terms. By using the app, you agree to these terms.

The service

Mynk is the web application these pages describe. It is also titled Tutoring Notes. It helps private tutors run a shared whiteboard session, record it, and draft the notes. When a note is finalized, the parent and student can see the notes and the lesson replay in their account.

An organization owner, admin, or scheduler can see learners that organization entered, including learners they did not personally teach. The organization enters the learner. A scheduler sees the name, a short brief, and a short reason when a booking is blocked, and does not see parent email, consent choices, or notes. A private tutor still sees only their own students.

Eligibility and accounts

You must be able to form a binding contract and, where applicable, have permission from your organization to use the service. You are responsible for safeguarding your account credentials and for activity under your account. You must not share your account with others.

Acceptable use

You agree not to:

  • Use the service to violate law or third-party rights.
  • Attempt to access data or systems you are not authorized to use.
  • Interfere with or disrupt the service or its infrastructure.
  • Use automated means to abuse, scrape, or overload the service without permission.
  • Send unsolicited bulk email or deceptive messages through any integration (including Gmail).
  • Use a Calendar integration to create or change events you are not authorized to manage, or to spam invitees.
  • Enter student or parent information without obtaining any consent required for that data and the use you intend.
  • Record session audio or share whiteboard / audio replays without obtaining appropriate consent, especially for sessions involving minors.

Your content

You retain ownership of the notes, student information, audio recordings, whiteboard content, and other content you enter. By using the service, you grant us permission to store and transmit that content as needed to operate the product (for example, storing notes in the database, storing audio in object storage, sending emails you initiate, generating share links you create, and processing audio through the transcription provider described in the privacy policy).

Gmail integration

If you connect your Gmail account, the app sends email on your behalf only when you click Email a reminder. That email is optional. The parent or student already sees the notes and the lesson replay in their account when you finalize a note. You can disconnect at any time from Settings, then Email. Your use of Gmail is also subject to Google's own terms of service.

Google Calendar integration

If you connect Google Calendar, the app may create, update, and delete events on your primary Google Calendar that correspond to scheduled sessions you manage in the app, using the calendar.events.owned permission. This is one-way sync from the app to Google — not push notifications, not two-way sync, and not CalDAV. In-app scheduling still works if Google sync fails. Disconnecting from Settings → Calendar integrations removes our stored token and stops future sync; it does not delete events already in your Google Calendar. Your use of Google Calendar is also subject to Google's own terms of service.

Calendar subscription feed

You may subscribe to a read-only ICS/webcal feed of your scheduled sessions. Your calendar application polls the feed URL on its own schedule; updates are not instantaneous. Session titles in the feed and in Google Calendar events we create use the student's first name and last initial (for example, “Tutoring — Maya R.”). Keep the subscription URL confidential; revoke it from Settings if it may have been exposed.

Mynk two-factor texts (SMS)

If you enable text-message two-factor authentication, you agree to receive Mynk two-factor texts: one-time passcodes only for signing in, completing SMS two-factor setup, or changing your SMS two-factor method—not marketing or promotional messages. Message and data rates may apply. Message frequency varies; we send texts only when you set up SMS two-factor authentication, sign in with SMS, or change your SMS two-factor method. For help, contact us using the support information on this page. Text HELP for help or STOP to opt out. See our privacy policy for how we handle your information. Carriers are not liable for delayed or undelivered messages.

Third-party services

The service relies on third parties (for example hosting, database, object storage, Google OAuth, Gmail, Google Calendar, OpenAI for transcription and note generation, email delivery, and Twilio for text-message two-factor authentication code delivery). Your use of those features is also subject to the third party's terms and policies. We are not responsible for outages or changes caused solely by third-party platforms. See Google Calendar integration and Calendar subscription feed above. The current list of subprocessors is in the privacy policy.

Availability and changes

We aim to keep the service available but do not guarantee uptime. Features may change or be removed. We will make reasonable efforts to notify users of significant changes via the app or by email where practical.

Children and parental consent

Tutoring Notes knowingly serves students who may be under 13 and is subject to the Children’s Online Privacy Protection Act (COPPA), 16 CFR Part 312. When a parent or guardian finishes setup for a child under 13, they represent that they are that child’s parent or legal guardian and that they have reviewed and consented to the privacy practices described in our privacy policy, including the collection of session audio recordings, transcripts, and notes.

When a parent or a self-learner has finished account setup, consent is recorded in that Mynk account before a live session. A parent records it for a child. A self-learner records it for themselves. A student who has not finished setup does not have that record yet.

Parents and legal guardians retain the right to review, request deletion of, and revoke consent for their child’s personal information at any time. See the privacy policy — specifically the “Children’s data and parental rights (COPPA)” section — for how to exercise these rights, our retention practices, and the contact address for deletion requests. Turning a consent off stops that new collection. Online, if audio recording is off, the tutor’s microphone can still be saved. It does not automatically delete data already collected under prior consent. A parent can ask Mynk to delete the account and its data. Deleting only some of it is a special request.

After an account is deleted, we keep a record of the consent choices that were made: which options were on or off, and when. That record does not include the person’s name or email.

Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation. Educational outcomes are not guaranteed.

Limitation of liability

To the fullest extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim arising out of these terms or the service is limited to the greater of (a) the amount you paid us for the service in the twelve months before the claim or (b) fifty U.S. dollars, if you have not paid a fee.

Indemnity

You will defend and indemnify the Operator against claims arising from your misuse of the service, your content, or your violation of these terms, to the extent permitted by law.

Changes

We may modify these terms or discontinue features. We will post the updated terms on this site with a new “Last updated” date. Material changes may also be communicated in-product or by email where practical. Continued use after changes constitutes acceptance.

Governing law

These terms are governed by the laws of the United States, without regard to conflict-of-law rules, except where mandatory local consumer protection laws apply in your country or region of residence.
